Introduction
Please read the following Terms of Service carefully before agreeing to dog waste removal services from Poopy Poochy - Pet Waste Removal, LLC.
Each Poopy Poochy - Pet Waste Removal, LLC client agrees to these terms upon signing up for and/or purchasing any of our services.
Poopy Poochy - Pet Waste Removal, LLC and its employees agree to provide purchased services in a professional, reliable, and trustworthy manner. In consideration of these services and as an express condition thereof, the client agrees to hold harmless and waive claims against Poopy Poochy - Pet Waste Removal, LLC and its employees, except for claims arising from gross negligence by Poopy Poochy - Pet Waste Removal, LLC staff or management.
Yard Conditions & Service Limitations
We remove pet waste that we can see to the best of our ability. Tall grass, overgrown weeds, improperly maintained landscaping, leaves, debris, straw, mulch, and rocks may negatively affect the results of a cleanup. Clients are responsible for maintaining grass, trees, bushes, shrubs, and other plant growth and for removing leaves and other debris from the yard.
We will remove visible pet waste found on top of leaves, straw, or mulch, but we will not search through piles or remove mulch or tanbark containing broken-down waste. Waste on rocks can break into smaller pieces and fall beneath the rocks; therefore, complete removal cannot be guaranteed. We will always make a reasonable effort to remove what is visible and accessible.
For decks and trampolines, we only remove waste that is accessible within arm's reach of our tools. We do not service beneath decks that are lower than 6 feet. For liability reasons, clients must move trampolines before service if the area underneath is to be cleaned.
If you notice an area being missed, please bring it to our attention so we can address it on subsequent visits. Your satisfaction is important to us, and we encourage you to contact us promptly with any concerns.
1. Staff Safety
Dogs can be territorial and protective. Even a friendly pet may react differently when a service provider enters its yard. If a client has any reason to believe a dog may be aggressive, anxious, overly dominant, or uncomfortable with strangers, the dog MUST be kept inside during the scheduled service visit.
Poopy Poochy - Pet Waste Removal, LLC texts clients when we are on the way. We will not enter or remain in a yard when a pet displays aggression, agitation, or behavior that creates a safety concern. If staff encounter an aggressive or unfriendly pet after entering the yard, we will make a reasonable effort to calmly exit the property. We reserve the right to protect ourselves as reasonably necessary under the circumstances. Dog repellent may be used if a pet attempts to bite or attack staff.
Clients are responsible for providing a reasonably safe working environment. If an animal attack occurs through no fault of Poopy Poochy - Pet Waste Removal, LLC, the client may be required to provide current vaccination records, and animal control or other appropriate authorities may be notified as required or permitted by applicable law and company policy.
Please notify us before beginning service if you have an aggressive, anxious, or overly dominant pet so appropriate safety procedures can be established. The safety of our staff and our clients' pets is a top priority.
2. Weather Policy
Poopy Poochy - Pet Waste Removal, LLC will provide service during rain, cold, and other adverse weather when conditions are reasonably safe. We may be unable to operate during severe thunderstorms, high winds, extreme temperatures, flooding, heavy snow accumulation, unsafe road conditions, or other hazardous conditions. Weather-related missed service weeks remain billable because accumulated waste from the missed visit must still be removed during a subsequent visit. When weather prevents service, the scheduled cleaning may be skipped and regular service will resume on the next scheduled service date. If you need an unscheduled cleaning before your next regular visit, contact us and we will make reasonable efforts to accommodate the request, but availability is not guaranteed. To help protect your property, we may also postpone service when yards are excessively muddy. Service will resume when conditions improve, generally on the next scheduled visit.
3. Payments
Recurring services are invoiced near the end of each month, generally on the 25th. Invoices may be sent by email or text message and are payable upon receipt. For one-time services, an invoice may be sent at the end of the business day, or payment may be made by cash or personal check after the cleaning. We accept major credit cards.
4. Service Times
We are unable to guarantee specific arrival times because routes are affected by numerous variables. We guarantee that service will be completed on the scheduled service day unless conditions require a delay or rescheduling. Service hours are generally from sunup to sundown. We work in most weather conditions. If weather or road conditions become unsafe, services may be paused and affected clients will be notified as soon as reasonably possible.
5. Service Days
Poopy Poochy - Pet Waste Removal, LLC may occasionally reschedule or change service days at its discretion. When practical, prior notice will be provided. Service days are determined by the client's address and established routes, which helps us operate efficiently and maintain competitive pricing.
6. Holidays
We do not provide regular service on the following holidays: New Year's Day, Easter, Memorial Day, Independence Day, Labor Day, Thanksgiving Day and the following Friday, and Christmas week.
7. Cancellations, Pauses, And Restarts
Clients may cancel service at any time, subject to the cancellation notice requirements stated below. When recurring service is canceled, the account and associated service information may be deleted. If service is restarted later, the client may be required to complete the signup process again and will be charged according to then-current pricing. Any previously grandfathered rate may be lost.
Service may be paused for up to 30 days. After 30 days, the account may be considered inactive. Restarting service may require a new signup and will be subject to then-current pricing.
8. Refunds
Payments for completed or scheduled services are generally non-refundable unless an error was made by Poopy Poochy - Pet Waste Removal, LLC. If service is canceled after the start of a prepaid billing cycle, we may continue providing service through the remainder of that paid billing cycle. When a refund is approved for a reason not caused by an error on our part, the refund may be reduced by applicable bank or credit-card processing fees and any prorated amount for services already provided, where permitted by law.
9. Satisfaction Guarantee
If you are not satisfied with a service, please notify us within 24 hours after completion. We will make reasonable efforts to revisit and correct the issue, including a same-day revisit when scheduling permits. Requests made more than 24 hours after service are considered final and do not qualify for a complimentary revisit. We will always make reasonable efforts to resolve concerns within these Terms of Service.
10. Late Payments
Invoices for recurring service are generally sent on the 25th of each month. If payment has not been received by the 1st, we may send another reminder. If payment remains outstanding, another collection attempt may be made approximately five days after the client's last service day.
If payment remains unpaid five days after the last service day, outstanding future visits may be removed from the schedule and a $5 late fee may be added each week until payment is received, to the extent permitted by applicable law. If reasonable collection attempts are unsuccessful, the account may be referred to a collection company or pursued through small claims court. Permitted filing, collection, and related costs may become the client's responsibility.
Initial Cleanups
If a client signs up through our online system and provides information about the number of dogs using the yard or the amount of time since the yard was last cleaned that does not match the conditions encountered at the initial cleanup, additional charges may apply. This applies whether the incorrect information was provided intentionally or unintentionally. Quotes for first-time cleanings are estimates and are subject to change based on actual yard conditions and the amount of waste present.
Waste Removal
Waste collected during service is hauled away and disposed of by Poopy Poochy - Pet Waste Removal, LLC.
Gain Or Loss Of A Pet
Clients are responsible for notifying us within 7 days of any increase or decrease in the number of pets using the property. Failure to report additional pets may result in a rate adjustment or termination of service. If we become aware of an unreported gain or loss of a pet, we reserve the right to adjust the service rate accordingly.
Keys
If Poopy Poochy - Pet Waste Removal, LLC has been given a key to a client's property or residence, the client is responsible for requesting return of the key when service is terminated or canceled. We are not responsible for unrequested or unreturned keys after service cancellation.
Referrals
Refer a friend and receive your next service FREE, subject to the following conditions: the referred person must be a new Poopy Poochy - Pet Waste Removal, LLC customer and must provide the referring client's first and last name when completing the quote form. The referring client must be an active recurring customer receiving weekly, bi-weekly, or once-monthly service and must have received service within the previous 30 days. The free service is earned after we complete service for the referred customer and that customer has paid in full.
Marketing Material
Clients grant Poopy Poochy - Pet Waste Removal, LLC permission to use photographs or images of services performed at the client's property or residence on our website, social media accounts, and other print or digital marketing materials, unless different arrangements have been made with Poopy Poochy - Pet Waste Removal, LLC management.
Cancellations / Charges
Either party may cancel residential service at any time. Residential service does not require a long-term contract and has no termination fee. Residential cancellations must be submitted in writing by email or through the client portal at least 24 hours before the next scheduled service day.
Commercial clients must provide at least 30 days' prior written notice by email or through the client portal to cancel service.
Service upgrades, downgrades, and cancellation requests must be submitted in writing by text or email to tim@poopypoochy.com and can generally take effect within 24 hours.
If we arrive at the property and cannot service the yard for any reason, or if a scheduled service is canceled without at least 24 hours' notice, a $10 service charge may be billed to the account. If we arrive and must wait for access, we will wait a maximum of 10 minutes. After 10 minutes, we may leave without servicing the yard and a $10 service charge may be billed to the account.
Policy Changes
These Terms of Service and policies are subject to change at any time. Clients are responsible for reviewing and remaining up to date with the current policy.
